The use of drone technology has increased over the past several years due to the relatively low cost of purchasing drones or other un-manned aircraft. With the rise in use of drone technology, Realtors have been using them for commercial purposes to take aerial photographs and video of property for use in marketing.
It is important for realtors to know that there are certain rules that pertain to using drones for these purposes. FAA rules require a permit if using a drone for commercial means. Therefore, if you are using a drone to take pictures of real property for use in marketing, you are using the drone for commercial means.
The good news is that the FAA is coming up with new, less restrictive rules for using drones in commercial settings. Permit applications are become easier to obtain. Approximately 400 to 500 permits were issued for real estate purposes last year.
If you are a realtor, and are using drone technology, please be sure to consult with an attorney to make sure you are not in violation of federal law when doing so. If you have any questions, please feel free to call us at (843) 903-1212.
